LangBot Cloud Terms of Service

1. Service Overview

LangBot Cloud (the "Service") is provided by the LangBot team ("we", "us", or "our"). It is a managed instant messaging bot platform. By using the Service, you agree to be bound by these Terms.

2. Service Availability

We strive to provide a stable and reliable service but do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to maintenance, upgrades, force majeure, or other reasons. We will make reasonable efforts to provide advance notice of planned maintenance.

3. Provided "As Is"

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

4. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  • WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, BUSINESS INTERRUPTION, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE.
  • THE ABOVE LIMITATIONS APPLY WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
  • IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD $15.

5. User Responsibilities

  • You are responsible for all content and messages sent through the Service.
  • You must comply with all applicable laws and regulations, including data protection and privacy laws.
  • You are responsible for backing up your important data. We are not liable for data loss for any reason.
  • You shall not use the Service for illegal activities, spam, or infringing on the rights of others.

6. Force Majeure

We shall not be liable for any service interruption or loss caused by force majeure events, including but not limited to natural disasters, war, government actions, cyberattacks, third-party service failures, power outages, or internet connectivity disruptions.

7. Third-Party Services

The Service may rely on or integrate with third-party services (such as messaging platforms, AI model providers, etc.). We are not responsible for the availability, accuracy, or reliability of third-party services. Use of third-party services is subject to their respective terms.

8. Service Modifications and Termination

  • We reserve the right to modify, suspend, or terminate the Service (or any part thereof) at any time.
  • We reserve the right to modify these Terms at any time. Continued use of the Service after modifications constitutes acceptance of the revised Terms.
  • If we terminate the Service, we will make reasonable efforts to provide advance notice.

9. Indemnification

You agree to indemnify and hold us harmless from any claims, losses, damages, liabilities, and expenses (including reasonable attorney fees) arising from your use of the Service, violation of these Terms, or infringement of third-party rights.

10. Dispute Resolution

Any disputes arising from these Terms shall first be resolved through friendly negotiation. If negotiation fails, either party may bring the dispute before a court of competent jurisdiction in the location of our principal place of business.
